Apple Takes Lead In The Battle 'Tablet'
Online, July 9, 2012 (Newswire.com) - It seems that Apple has succeeded in urging the US court to impose a ban on the sales of Samsung's Galaxy Tablet 10.1 in the United States after being charged of copying the patented design of Apple's product, iPad. The reports say that the triumph also marks Apple's victory in the ongoing "thermonuclear war" against Google's Android operating system.
Although, the U.S. District Judge, Lucy Koh earlier discarded Apple's appeal to forbid the sales of Samsung's product in the country but was compelled to consider the case after an appeal by the court. Considering the case, she said that although Samsung has the full right to compete, yet it does not have the right to compete by using unfair means, i.e., by overflowing the market with a product identical to a patented product. She also told that if later the case was found to be invalid, Apple will pay a 2.6 million dollars bond to Samsung, i.e. if the charges are found to be wrong.
Reports stated that, Apple has also lodged a similar complaint against Samsung's Galaxy S III this month. Samsung, in the meantime, is likely to file a petition against the ban and condemned Apple for being too small in its perspective. In a statement, it said that if Apple continues to play such legal games with companies over designs, innovations and patents, then the industry will soon be restricted to limited products and a major loss will be incurred by the consumers.
An Apple representative said in a statement that, it is not a right practice to copy the ideas of the company and they need to protect the firm's intellectual asset.
Research shows that, Apple has sold more than 13.6 million iPads in the first quarter covering 60% of the market share, while Samsung sold only 1.6 million tablets with only 7% of the overall market share.
