"In terms of products, any new drug that comes out, if you watch it, in three or four years, you'll see where the failure to test was. It's always a risk versus benefit test, and a question of whether there really was a safer alternative to achieve the benefit. Not every device or pharmaceutical product is a good subject for litigation since most will not cause an injury that wasn't knowable to the physician or the patient, but some do. So, the trends change all the time."

With over 30 years dedicated to law, Presby brings a wealth of knowledge to her industry, particularly to her areas of specialization, personal injury, products liability, and pharmaceutical injury law. When asked why she decided to pursue to career in law, Presby said:

"I had a desire for justice that hit me when I was eight years old. I remember writing out my life plan in the third grade, and it included going to law school at SMU, where I actually ended up going."

Since graduating from SMU in 1984, Presby’s career has been marked by compassion and perseverance in representing individuals who have been harmed by defective products and negligent pharmaceutical corporations. Her success has culminated being named the Head of the Pharmaceutical Department at Nemeroff, where she focuses on litigation against pharmaceutical companies for injuries that consumers suffer from using their products. She notes that a typical claim is from a company failing to provide full and accurate information to the physicians or the FDA about a given drug.

As a thought-leader in her industry, Presby keeps abreast of recent trends that could potentially affect consumers of pharmaceutical products. In particular, she notes the challenge of staying current on the myriad of new drugs and other pharmaceutical devices that reach the market every year. She noted:

"In terms of products, any new drug that comes out, if you watch it, in three or four years, you'll see where the failure to test was. It's always a risk versus benefit test, and a question of whether there really was a safer alternative to achieve the benefit. Not every device or pharmaceutical product is a good subject for litigation since most will not cause an injury that wasn't knowable to the physician or the patient, but some do. So, the trends change all the time."

Presby is an Adjunct Professor at Southern Methodist University Dedman School of Law where she teaches Product Liability. Previously, she has worked for the law firms Baron & Budd, P.C. and Miller Weisbrod, LLP.
